Landmark decision of NSW Supreme Court
We are very pleased for our 10 clients who, as off-the-plan purchasers, successfully resisted the vendor/developer's attempt to rescind their sale contracts following the expiry of the 'sunset date'. This is a landmark decision of the NSW Supreme Court that provides important guidance to the property industry on how section 66ZL of the Conveyancing Act 1919 (NSW) will be applied going forward.
Please feel free to contact Mark Deutsch or Chris Stevens if you would like any assistance with property related litigation, including disputes involving development agreements or contracts of sale.
